INDIAN POLITY (PART-5)

  • As per Article 87 the president of India at the commencement of the first session after each general election and at the commencement of the first session in the year shall address Parliament assembled together.
  • President has the right to address either House of the Parliament or both Houses of the Parliament assembled together. He also has the right to send messages to either House of the Parliament.
  • President of India may prorogue either house of the Parliament. He may also dissolve the House of People.
  • The president of India summons the Parliament. Period of six months shall not be elapsed between two sittings.
  • Qualifications for the membership of Parliament: He is a citizen of India. He has 30 years of age for Rajya Sabha and 25 years for Lok Sabha. Other qualifications prescribed by the Parliament.
  • The period of duration of the House of the People (Lok Sabha) is 5 years from the date of its first meeting. However it may be extended to one year at a time during the proclamation of Emergency.
  • As per Article 83 of the Constitution Rajya Sabha shall not be dissolved. One-third of the members of the Rajya Sabha shall retire on the expiration of every 2 years.
  • As per Article 81 House of People (Lok Sabha) shall consists of 530 members from states and 20 members from union territories.
  • As per Article 80 Council of States (Rajya Sabha) shall consists of 12 members nominated by the President. 238 members representing states and union territories.
  • Prime Minister is the head of Council of Ministers.
  • The Council of Minister shall aid and advise the President.
  • Ministers must have membership in either house of the Parliament. If a person who is not a member of either House of the Parliament is selected as minister he should be elected to the either House with a period of six months from the date of assumption of office.
  • The Prime Minister is appointed by the President and other Ministers are appointed by the president on the advice of the Prime Minister. (Article 75(1))
  • The Ministers hold office during the pleasure of the President.
  • As per Article 75(3) of the Constitution the Union Council of Ministers shall collectively responsible to the House of the People (Lok Sabha).
  • The real executive head of the Union Government is the Prime Minister.
  • The Prime Minister is a line between President and the Council of Ministers.
  • The Prime Minister is the leader of the Cabinet and Union Council of Ministers.
